Step 5: Construction Permit

The construction permit is required in the state of Missouri for a Class I (IA, IB or IC) operation prior to building an operation. A Class II operation which discharges through a man-made conveyance or has been designated by MDNR on a case by case basis would need to apply for a construction permit. Construction Permit Application Requirements

An application for a construction permit must be submitted to MDNR at least 180 days in advance of the date on which construction begins. Upon receiving the construction application, MDNR will check over the application and make a determination on whether it is complete or not. If the application is determined incomplete, the applicant will be notified and allowed to correct the application. Once the application is determined complete, the overall review of the application will begin. The application will be checked to determine if it is in compliance with applicable regulations and laws. Once all issues have been addressed, MDNR will begin to prepare a construction permit.

The next step will depend on which type of operating permit will be needed for the operation, either a general or site-specific operating permit. Step 6 will address the requirements and differences between each permit.

If seeking a general operating permit, responses to any comments from the neighbor notification must be prepared with the construction permit. If seeking a site-specific operating permit, the operating permit must be public noticed for a 30-day period. After the public notice period, responses to any comments must be prepared in the same manner as the general operating permit.

MDNR shall issue or deny construction permit within 60-180 days of the department's receipt of an application. A construction permit is issued for a one year period.
