Neighbor Notification Requirements

Class IA, IB, and IC CAFOs in the state of Missouri must complete neighbor notification requirements prior to filing a construction permit. The following information must be compiled:
    1. The number of animals designed for the operation.
    2. The waste handling plan and general layout of the operation.
    3. The location and number of acres of the operation.
    4. Name, address, and telephone number of registered agent.
    5. Notice that MDNR will accept written comments for a 30-day period. The 30-day period will begin on the day the construction permit application is received by MDNR.
    6. The schedule date that the operation intends to submit a construction permit to MDNR.
    7. MDNR's address for receiving comments.
After this information concerning the concentrated animal feeding operation is put together, the neighbor notice shall be provided to the following parties:
    1. MDNR's Water Pollution Control Program;
    2. The county governing body; and
    3. All adjoining owners of property located within one and one-half times the buffer distances required for facilities.

    Size of Operation Buffer Distances
    Class IA (7,000 or more AUs) 3,000 feet
    Class IB (3,000 to 6,999 AUs) 2,000 feet
    Class IC (1,000 to 2,999 AUs) 1,000 feet

    Distances are to be measured from the nearest animal confinement building or waste holding basin to the adjoining property line.

The construction permit applicant shall submit to MDNR proof the above notification has been sent. The neighbor notice will expire if a construction permit application has not been received by the department within 12 months of initiating the neighbor notice requirements.
